Environmentally motivated unilateral trade measureshave been at the center of attention in the WorldTrade Organization's dispute settlement apparatus andin other organs of the multilateral trading system. The controversy around these measures concerns, firstand foremost, their legality under the WTO rules. Thebook addresses the question whether environmentallymotivated unilateral trade measures are allowed inthe WTO. It argues that these measures are allowed inthe system only as a last resort and only if theirapplication runs congruent to the values andobjectives recognized by the system. It suggests atechnique by which the scope of legality ofenvironmentally motivated unilateral trade measuresmay be clarified. It is hoped that the discussionand proposition in this book will contribute to thediscourse on the clarification of the status ofenvironmentally motivated unilateral trade measuresin the WTO.
