Since detention is an exception to the principle of liberty, any person who has been provisionally arrested has the right to apply for provisional release on payment of a bond, which may guarantee his provisional release pending the final decision of a competent court, in the knowledge that the bond will be refunded to him if he is acquitted by a final decision. Thus, this work starts from empirical facts observed in the Congolese jurisdiction, which are different from the legal letter in force in the Democratic Republic of Congo.
