While Reason has ceased to have its seat in history, as our times prove, the rule of law, which was to be its embodiment, finds itself torn between its norms and the facts, subject to economic and political imperatives and, consequently, to increasing functional instrumentalization. Thus, the question that arises today is whether the idea of the rule of law is not necessarily held in check by the complexity of societies, by domination. Indeed, in several corners of the world, there are persistent social tensions that block progress, giving rise to political unrest and armed conflict. The continual violation of fundamental human rights, with all its consequences, has become commonplace. Peace is confused with unanimity or tranquillity imposed by force, ensuring the maintenance of a group of men in power at the expense of the people. In such situations it becomes impossible for citizens to participate in public life or to give effect to the weight of their collective opinion. This is the subject of this book.
